Precision agriculture has the power to disrupt farming as we know it, and it will be driven by artificial intelligence (AI) and machine learning (ML). But farmers, their suppliers and purveyors of precision ag technologies also need to be aware of the associated legal risks.

Consider the example of orchard management software that uses an AI model to output precision recommendations for pesticide applications. If the AI model recommends application of a pesticide at a concentration in violation of a government regulation, where does liability lie?
